When an attack was foreseeable and the owner did nothing, the owner may share responsibility.

What it means

Owners of apartments, hotels, parking lots, gas stations and businesses can be responsible when a criminal attack on their property was reasonably foreseeable and they failed to take reasonable security steps.

Recent changes in Georgia law

Georgia changed some rules for negligent security cases in recent years, including how fault is divided with the person who committed the crime and what must be proven. These changes make careful investigation even more important.

What we look for

  • Prior similar crimes at or near the property
  • Broken gates, locks, lights and cameras
  • Security complaints from residents or guests
  • Security policies and staffing
This is not about blaming the victim. It’s about whether the property owner did what it should have done.
